Terms & Conditions

The terms below govern self-drive vehicle rentals with KOI. Please read them before booking — by renting a vehicle from us, you agree to these terms and to the rental agreement you sign at handover.

1. About these terms

These terms govern the rental of a vehicle from KOI Car Management Sdn. Bhd. (“KOI”, “the Company”, Reg. No. 202501022262 (1623675-P)). They summarise the rental agreement you sign at handover; the signed agreement is the binding contract and prevails where there is any conflict.

By booking or taking delivery of a vehicle, you (“the Renter”) agree to these terms.

2. Customer declarations

By renting, the Renter declares that:

  • All personal and payment information provided is accurate and up to date.
  • They consent to the Company verifying their information, including credit and background checks.
  • They have inspected the vehicle and accept it is in good condition unless otherwise noted at handover.
  • They understand and accept the Company's terms, including insurance, damages, and rental rules.

3. Security deposit

  • A refundable deposit is collected before pickup.
  • The Company may deduct any outstanding rental, fees, penalties, or damages from the deposit.
  • The remaining deposit is refunded within 7 working days for KL/Selangor rentals, and up to 3 months for outstation rentals.
  • The deposit cannot be used to offset rental fees unless explicitly agreed in writing.

4. Fuel policy

  • The vehicle must be returned at the same fuel level as received.
  • No refund is given for extra petrol left in the vehicle.
  • Failure to return at the same fuel level will incur fuel charges.

5. Mileage

  • 200 km per day is included.
  • Excess mileage is charged at the Company's prevailing rate.

6. Vehicle use & restrictions

The Renter agrees to:

  • Operate the vehicle only in accordance with Malaysian law and Company instructions.
  • Not allow unauthorised drivers.
  • Not operate the vehicle off-road, on unpaved or non-gazetted roads, or outside Malaysia without written approval.
  • Avoid smoking, vaping, or carrying pets, durians, salted fish, or heavy/odorous items in the vehicle.
  • Carry out regular engine oil, water, and tyre checks before travel.
  • Drive diligently; failure to follow the vehicle manual may result in charges for damages.

7. Accident, damage & liability

Insurance coverage: The vehicle is insured and covers all authorised drivers. The Renter must inform KOI before making a police report in the event of an accident.

Customer responsibility: In a covered incident, the Customer must pay the daily rental rate while the vehicle is in the workshop, the insurance excess plus related administrative/manpower/documentation costs, depreciation loss caused by the accident, and internal damage or tyre punctures caused by negligence or improper operation.

Non-claimable situations: Insurance may be rejected if the Renter drives under the influence, drives recklessly/illegally, uses an unauthorised driver, drives off-road/in restricted areas/outside Malaysia without approval, fails to notify the Company or make a police report within 24 hours, overloads, uses the wrong fuel, or ignores maintenance instructions. In these cases the Renter pays full repair costs, depreciation, loss-of-use, and all related fees.

Total loss or theft: If the vehicle is stolen or written off, the Renter pays any shortfall not covered by insurance, plus loss-of-use and depreciation costs.

Towing & repairs: The Renter must not arrange towing or workshop services, or allow any unauthorised towing company or workshop to handle the vehicle. The Company uses its panel workshop and approved providers for all repairs. Costs from unauthorised towing or repairs are charged fully to the Renter.

8. Company rights

  • Repossession / rejection: If the Renter is found to have a criminal, drug, or commercial case in their identity record, the Company may refuse rental or repossess the vehicle without returning payment.
  • Risk management: If the Company reasonably suspects the Renter is involved in criminal activity, is under the influence, or behaves in a manner deemed risky, it may refuse rental or repossess the vehicle without returning payment.

9. Extensions & early termination

  • Extensions requested at least 24 hours before rental expiry may be granted, subject to availability and rate.
  • Payment for any extension must be made at least 12 hours before the extended period begins.
  • Cancellation 14 days or more before commencement: full refund via credit voucher (valid 6 months).
  • Cancellation within 14 days of commencement: RM300 charge, with the remainder via credit voucher.
  • After commencement: no refund for unused days.

10. Return of vehicle

  • The vehicle must be returned to Company premises or an agreed location.
  • Delivery or repossession outside Company premises incurs an RM10/km fee.
  • A differential fuel level may incur additional charges.
  • Late return incurs double the daily rental until the vehicle is returned.

11. Fines, penalties & summonses

  • The Renter indemnifies the Company for all fines, penalties, and summonses incurred during the rental.

12. Keys, accessories & personal belongings

  • The Renter is responsible for safe keeping of the vehicle keys and accessories.
  • Lost or damaged keys or gadgets must be replaced at the Customer's expense.
  • The Company is not responsible for personal belongings left in the vehicle.

13. Indemnity

The Renter indemnifies and holds the Company harmless for losses arising from vehicle operation or use, breach of obligations under the agreement, and legal or financial claims arising from the Customer's actions. These obligations survive termination or expiry of the agreement.

14. Payment & interest

  • All rental, fees, and damages must be paid immediately upon demand.
  • Late payments incur interest of 18% per annum from the due date until payment.

15. Maintenance & servicing

Mechanical maintenance and servicing of the vehicle is undertaken by the Company. Upon being notified, the Renter must return the vehicle for maintenance and servicing.

Maintenance and servicing do NOT cover repairs or replacement of parts resulting from road accidents, intentional damage, negligence or improper use, any intentional act, or overhaul repairs. The Renter is responsible for any costs arising from the above.

16. General

  • Governing law: This agreement is governed by the laws of Malaysia.
  • Time: Time is of the essence in all obligations under the agreement.
  • Conclusive evidence: Invoices, statements, and notices signed by Company officers are conclusive proof of amounts owed by the Renter.
  • Internal car damage and tyre punctures caused by Customer negligence are chargeable.
  • Smoking, durians, salted fish, or pets in the vehicle: RM250 of the deposit is forfeited.
